Country Bros Pool Service – Terms and Conditions of Service

1. Service Agreement
By enrolling in pool maintenance or related services provided by Country Bros Pool Service (“Company”), the customer (“Client”) agrees to the following terms and conditions. These terms apply to all recurring and one-time services, including cleaning, maintenance, repairs, and chemical treatments.

2. Service Schedule
Frequency: Standard service is provided once per week, unless otherwise specified in writing.
Service Days: Service is typically performed Monday through Friday, excluding major holidays.
Holiday Schedule: No service will be provided on the following holidays: New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving (Thursday & Friday), and Christmas Week (December 22–26).
Weather Delays: During heavy rain, lightning, or unsafe conditions, services may be limited to chemical balancing and basket inspection. Full cleaning may be rescheduled for the next service cycle.

3. Access and Safety
The Client must ensure unrestricted access to the pool and equipment on the scheduled service day. Locked gates, aggressive pets, or construction blocking access may result in a missed service without refund.
Electrical panels, timers, and pool equipment should remain accessible and unobstructed.
Country Bros technicians are not responsible for activating customer water hoses or using any on-site equipment unless explicitly approved.

4. Service Scope
Routine weekly maintenance includes:
Skimming, brushing, vacuuming (as needed for debris and dirt removal)
Emptying skimmer and pump baskets
Inspecting equipment for visible leaks or malfunctions
Testing and balancing water chemistry
Adding standard chemicals (chlorine, acid, stabilizer, etc.) as needed
The following services are not included in routine maintenance unless billed separately:
Filter cleaning or replacement
Equipment repair, replacement, or installation
Algae treatment or green-to-clean recovery
Drain and refill, acid washes, or tile cleaning
Specialty chemical treatments or salt cell cleaning

5. Chemicals and Water Quality
Chemical costs are included in the monthly service rate unless otherwise stated.
Pools with excessive debris, neglected condition, or recurring algae due to poor circulation or filtration may require additional chemical treatments at the Client’s expense.
The Company is not responsible for water loss, staining, or equipment damage resulting from low water levels, neglected maintenance, or prior service provider issues.

6. Pricing and Payment
All recurring services are billed monthly in advance.
Payment is due upon invoice or as set up through automatic recurring billing (credit card or ACH).
A $25 late fee may apply to payments not received within 10 days of the due date.
Services may be paused or discontinued for non-payment beyond 15 days.
Rates are subject to change with 30 days’ written notice to reflect increased chemical or operational costs.
No prorations or refunds will be issued for service interruptions caused by weather, access issues, or mid-month cancellations.

7. Cancellation Policy
The Client may cancel recurring service at any time with 7 days’ written notice prior to the next billing cycle.
Cancellations mid-cycle will not result in prorated refunds.
Outstanding balances must be paid in full prior to cancellation taking effect.

8. Equipment and Repairs
The Company may recommend equipment repairs or replacements when necessary for safe and efficient pool operation.
All repairs over $150 require prior customer approval.
The Company is not liable for pre-existing equipment failures, leaks, or plumbing defects that existed prior to service commencement.

9. Liability and Limitations
The Company is fully insured for general liability and property damage.
Country Bros Pool Service is not responsible for:
Pre-existing damage or staining on plaster, tile, or decking.
Damage caused by faulty equipment, structural defects, or acts of nature (e.g., storms, animals, debris).
Electrical or plumbing issues outside the scope of pool maintenance.
Client acknowledges that pool surfaces and materials naturally age and may show wear over time; the Company cannot guarantee prevention of such effects.

10. Communication and Reporting
Customers will be notified via text or email if an issue, part replacement, or abnormal condition is observed.
All communications regarding billing or service concerns must be submitted via text or email for record-keeping purposes.
Field technicians do not handle billing or pricing disputes directly.

11. Suspension or Termination of Service
The Company reserves the right to suspend or terminate service at any time due to:
Unsafe conditions (e.g., aggressive pets, unstable structures)
Repeated access restrictions
Consistent late or missed payments
Pools that pose health or safety hazards (e.g., severe algae or chemical imbalance)

12. Warranty Disclaimer
All services are provided “as is” and no guarantees or warranties are made beyond the completion of the stated scope of work. The Company disclaims responsibility for chemical or equipment-related results outside normal service parameters or due to unreported equipment failure.

13. Indemnification
Client agrees to hold harmless and indemnify Country Bros Pool Service, its owners, and employees from any claims, damages, or losses arising from:
Misuse of the pool or equipment by the Client or third parties,
Pre-existing damage or deferred maintenance,
Failure to maintain proper water level, safety barriers, or access security.

14. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through informal discussion. If unresolved, disputes will be submitted to binding arbitration in Bexar County, Texas, under the rules of the American Arbitration Association. Each party bears its own legal costs.

15. Agreement and Modifications
By using Country Bros Pool Service, the Client acknowledges receipt and acceptance of these Terms and Conditions.
The Company may update these terms periodically, with notice provided via email or posted on official billing documents.
